Terms of Service

These Terms of Service ("Terms") govern your use of the Pecly mobile application and website at https://pecly.app (collectively, the "Service"). By using Pecly, you agree to these Terms.

Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Pecly. If you are under 18, you represent that you have permission from a parent or guardian.

The Service

Pecly provides AI-assisted photo retouching tools, including style presets, before/after comparison, and export features. Results may vary depending on input photo quality, lighting, and selected style. We do not guarantee that every edit will meet your expectations.

Your content

You retain ownership of photos you upload or capture. You grant us a limited license to process your images solely to provide the Service and improve reliability and safety of our systems. You represent that you have the right to use and edit any photo you submit.

You agree not to upload content that:

• Violates someone else's privacy, publicity, or intellectual property rights
• Is illegal, abusive, harassing, or sexually exploitative
• Attempts to bypass safety systems or abuse the Service

Subscriptions and billing

Pecly may offer free and paid ("Pro") plans. Paid subscriptions are billed through the Apple App Store or Google Play Store. Payment, renewal, cancellation, and refunds are governed by the applicable store's terms and policies.

• Subscriptions renew automatically unless canceled before the renewal date
• Manage or cancel your subscription in your App Store or Play Store account settings
• Restore purchases from within the Pecly app if you reinstall or switch devices
• Free trial or promotional access, if offered, converts to a paid plan unless canceled in time

Prices and features may change. Where required, we will provide notice through the app or store listing.

Acceptable use

You agree not to:

• Reverse engineer, scrape, or misuse the Service
• Use Pecly to create deceptive, fraudulent, or harmful imagery
• Overload or interfere with our infrastructure
• Resell or redistribute the Service without permission

AI-generated output

Edits are generated algorithmically. You are responsible for how you use and share results. Do not present AI-enhanced images as unedited documentary evidence where authenticity is required.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PECLY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

Termination

We may suspend or terminate access to the Service if you violate these Terms or if we discontinue the Service. You may stop using Pecly at any time. Sections that by nature should survive termination will remain in effect.

Changes

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the updated Terms.
